1. Vehicle Handover

1.1 At the time of delivery, I will acknowledge receipt of the vehicle by signing a physical checklist or confirming digitally through the Vehicle Delivery App. The checklist will confirm essential details including the vehicle’s make, model, and registration number. The rental period shall commence immediately upon handover, in accordance with the applicable terms and conditions.

1.2 Prior to the commencement of the ride, both the guest and the LuxiCars representative must mutually verify and approve the checklist (Annexure 1). This process includes validation of the driver’s age and driving license, as well as photographs of all sides of the vehicle (including the registration plate) and interior images such as the speedometer, captured by the LuxiCars representative.

2. Vehicle Return

2.1 Upon completion of the rental or any approved extension, I will ensure that all personal belongings are removed from the vehicle. LuxiCars shall not be responsible for any items left behind.

3. Booking Rejection

3.1 LuxiCars reserves the right to decline any booking at its sole discretion, without providing a reason. In such cases, any Security Deposit and Subscription Fees paid in advance shall be refunded within 5–7 business days.

5. Rental Extension

5.1 Requests for rental extensions must be made at least 4 hours prior to the scheduled return time. Extension approval is subject to vehicle availability. Upon approval, applicable charges must be paid via the app, website, or payment link provided by LuxiCars.

6. Vehicle Use

6.1 I agree to comply with the following conditions during the rental period:

  • 6.1.1 Adhere to the Indian Motor Vehicles Act, 1988, and all subsequent amendments.

  • 6.1.2 Comply with LuxiCars’s Vehicle Usage Terms at all times.

  • 6.1.3 Use the vehicle strictly for its intended purpose.

  • 6.1.4 Operate the vehicle in accordance with manufacturer specifications and applicable laws.

  • 6.1.5 Do not perform or authorize any repairs or modifications without prior approval.

  • 6.1.6 Inform LuxiCars and submit relevant license details if an additional driver is authorized.

  • 6.1.7 Do not tamper with the odometer or any vehicle accessories; replacement costs shall apply.

  • 6.1.8 Obtain written consent from LuxiCars before taking the vehicle outside India.

  • 6.1.9 Do not exceed the vehicle’s permitted passenger capacity.

  • 6.1.10 Do not use the vehicle for commercial transportation of passengers or goods.

  • 6.1.11 Animals are strictly prohibited; violations may attract cleaning or damage charges.

  • 6.1.12 Do not use the vehicle for racing, motorsports, or speed testing.

  • 6.1.13 Do not tow or push other vehicles.

  • 6.1.14 Observe LuxiCars-imposed and legally mandated speed limits.

  • 6.1.15 Do not operate the vehicle under the influence of alcohol, drugs, or any impairing substance or condition.

  • 6.1.16 Refrain from any action that may invalidate the vehicle’s insurance coverage.

  • 6.1.17 Do not modify the vehicle without prior written approval.

  • 6.1.18 Follow the instructions in the vehicle owner’s manual, where available.

  • 6.1.19 Report any mechanical or operational issues immediately to LuxiCars Support and follow provided instructions.

  • 6.1.20 Bear all costs related to tolls, parking, road taxes, and interstate permits. Any FASTag charges incurred by LuxiCars will be reimbursed along with applicable GST.

  • 6.1.21 In the event of a breakdown, do not abandon the vehicle and wait for Roadside Assistance or a replacement as directed by LuxiCars.

  • 6.1.22 LuxiCars reserves the right to monitor or restrict vehicle usage in the event of policy violations.

7. Security Deposit

7.1 In the event of vehicle damage during the rental period, I authorize LuxiCars to deduct applicable repair charges from the Security Deposit in accordance with this agreement.

7.2 The Security Deposit shall be refunded within 5–7 business days after completion of the rental, after adjusting any outstanding charges.

8. Vehicle Condition Upon Return

8.1 I shall return the vehicle in its original condition, subject to normal wear and tear. Excessive damage, wear, or uncleanliness may result in additional charges, including cleaning fees as specified in the Fee Schedule.

8.2 Failure to return the vehicle at the end of the rental or extension period shall be treated as theft or loss. LuxiCars reserves the right to initiate legal proceedings and repossess the vehicle without prior notice. This agreement authorizes LuxiCars to recover the vehicle without further consent.

9. Support and Maintenance

9.1 I will maintain the vehicle in a clean condition and promptly report any maintenance concerns. Emergency repairs outside the delivery location must be conducted only at authorized workshops, with original invoices submitted within 5 business days for reimbursement.

9.2 Routine servicing will include vehicle pick-up and drop-off at the original delivery location. I will notify LuxiCars Support at least 2 hours in advance if a change in location is required.

10. Accidents

10.1 I shall be solely responsible for any accidents involving third-party injury, death, or property damage. If the vehicle is seized or impounded, I will bear all related costs and liabilities.

10.2 I agree to indemnify and hold LuxiCars and its representatives harmless against any losses, damages, or expenses arising from such incidents.
